Working in the UK and the Points-Based Immigration System

Understand the Points-Based Immigration System and what immigration permission you may need to work in the UK.

Procedure

Due to the recent Government announcement relating to upcoming changes to the Skilled Worker Visa, please note this webpage is under review

Eligibility to work in the UK

The University is obliged to ensure all workers are eligible to work in the UK and it is vital that the appropriate checks are completed prior to any work being undertaken.

You will have the right to work in the UK if:

  • you're a British or Irish citizen (but not a British Overseas Citizen, British National (Overseas) or British Protected Person)
  • you have pre-settled/settled status or a family permit under the EU Settlement Scheme
  • you have indefinite leave to enter or remain in the UK
  • you have right of abode in the UK

If you require permission to work in the UK, it is likely that you will need a work visa.

The Points-Based Immigration System allows employers to recruit non-UK/Irish citizens to work in the UK in a specific job in an eligible skilled occupation.

Each of the visas offered under the Points-Based Immigration System have different requirements and you will need to pass a points-based assessment before you can get permission to work in the UK.

Visa types

Visa type Description of work
Skilled Worker for skilled workers with a job offer, such as academics and researchers
Student/Tier 4 for students
Temporary Work for temporary workers, such as sponsored researchers or participants in the Youth Mobility Scheme

The Department of Human Resources administers the University's licence for Skilled Worker, Temporary Work − Government Authorised Exchange and Temporary Work − Creative Worker. In particular circumstances, we may be able to sponsor individuals under these types of visa.

Other non-sponsorable visas may allow for work in the UK such as the Global Talent Visa.

Please email the Staff Immigration Team at hr-visas@bath.ac.uk if you have any queries.

Responsibilities

We have a legal obligation to comply with the requirements set out under the Points-Based Immigration System. These include a number of responsibilities which are required to be adhered to by sponsored workers, line managers, and the Department of Human Resources.

It is important that you read the guidance on Points-Based Immigration System responsibilities to ensure you understand your responsibilities under the Points-Based Immigration System.
