To advance student understanding of the principles and practices of the UK legal system and its impact on the operation of companies with a particular focus on environmental law and waste management in an industrial context.

Learning Outcomes:
After successfully completing this unit the student should be able to:
* Apply basic legal principles and environmental legislation to real world scenarios;
* Describe and analyse the legal framework in which companies are required to operate;
* Describe and evaluate the effectiveness of the UK and EU environmental legislation;
* Interpret and apply the legislation which applies directly to waste management;
* Formulate schemes of waste minimization and management for an industrial process.

Content:

* Common law/statute law with examples in Health & Safety at Work Act; Employment Law; structure of the courts and ADR; criminal and civil liability overview
* Law of contract: terms and exemption clauses under U.C.T.A. 1977.
* Law of tort: negligence and defences
* Contract of service vs contract for service: duties of employer and employee.
* Legislative concepts including regulations, directives & decisions, precedent, delegated legislation and the roll of treaties, conventions and protocols. Important definitions including BPEO, IPPC and BAT.
* Legal concepts in the enforcement of environmental law including polluter pays, precautionary, proximity and future liability.
* The role of the Environment Agency and Local Authorities in enforcing environmental law. This includes administrative action, criminal proceedings, civil proceedings, sentencing and fines.
* Practices for management of waste to include hierarchies of good waste management.
* Outline treatment and technologies for solid, liquid and gaseous wastes and application of BAT.
* Overview of nuclear and hazardous waste management.
